The following information was provided by Gale Smith-Camp, Branch Manager of our Sacramento office. This insures she has the most up to date information on the changes that affect all clients of United Corporate Services, Inc., nationwide.
SUBJECT: Affidavit of Identity Form Requirement (AB 1325)
Effective January 1, 2014, pursuant to Assembly Bill 1325,
County Registrar/Recorder County Clerk’s Offices will require a completed Affidavit of Identity form to accompany the 2014 Fictitious Business Name Statement (Original, Re-file and New).
Due to the recent legislative changes which went into effect January 1,2014, there have been changes and additions to the Fictitious Business Name forms. Pursuant to the California Business and Professions Code Section 17913, counties may require that additional forms be submitted with the Fictitious Business Name Statements. These include the Affidavits of Identity for the registrant (if filed by mail or in person by registrant) and for the third party submitting the form on behalf of another party.
Please note the form for the registrant must be notarized and the third party form must be signed in the presence of the clerk. Some counties are requiring a Certificate of Status; some counties are requiring a copy of the filed organization documents from the Secretary of State and some counties are filing without any of these additional documents. Based on our research, counties are interpreting these requirements differently, so it will be determined on a county by county basis.
