Home COVID-19 USPTO Extends deadlines for Trademark and Patent applications

On March 31st, the United State Patent & Trademark Organization, as granted authority through the CARES Act, announced that in response to the disruption to businesses caused by the spread of COVID-19, it was extending the due dates for submission and payment of certain trademark and patent applications. These extensions provide relief for:

  • Trademark Applicants
  • Trademark Registrants
  • Parties to TTAB Proceedings
  • Patent Applications
  • Patent Reexamination Proceedings

Applications that were due March 27th and April 30th will be extended 30 days from the initial due date as long as the application is accompanied by a statement that indicates that the practitioner, applicant, registrant, or other person associated with the filing or fee was personally affected by COVID-19, including, without limitation, the following:

  • Office Closures
  • Cash Flow Interruptions
  • Inaccessibility to files or other materials
  • Travel Delays
  • Personal or Family Illness
  • Similar Circumstances
